What Are the Penalties for a Sex Crime in Kansas?

Penalties depend on how the offense is classified. Sex crimes in Kansas can be charged as misdemeanors or felonies, and felony convictions can carry prison sentences exceeding one year along with the loss of certain constitutional rights.

Felony Severity Levels and Sentencing Ranges

Kansas uses a severity level system to classify felony offenses. Sexual battery is a Class A misdemeanor carrying up to one year in jail and a $2,500 fine. Aggravated sexual battery is a Severity Level 5 person felony with a sentencing range of 2.5 to 10.5 years in prison and fines up to $300,000. Rape, defined under Kansas law as sexual intercourse without consent where the victim is overcome by force or fear, is physically helpless, or can’t consent due to a mental condition or intoxication, is a Severity Level 1 person felony carrying 12 to 54 years in prison and up to $300,000 in fines. When the alleged victim is under 14 and the offender is an adult, rape becomes an off-grid person felony with a potential sentence of life in prison and fines up to $500,000.

Sex Offender Registration Under Kansas Law

A conviction for many sex offenses triggers mandatory registration under the Kansas Offender Registration Act. Registrants must maintain a profile in a nationwide database, with ongoing update, check-in, and notification requirements that continue for years or for life.

Registration periods are tiered by offense. A 15-year requirement applies to offenses such as sexual battery and lewd and lascivious behavior with someone under 18. A 25-year requirement applies to offenses including aggravated sexual battery, indecent liberties with a child, electronic solicitation, and sexual exploitation of a child between the ages of 14 and 18. Lifetime registration applies to convictions for rape, aggravated criminal sodomy, aggravated human trafficking, aggravated indecent liberties with a child, and similar offenses. A second or subsequent conviction for a registerable offense may also result in lifetime registration regardless of the underlying charge. Failing to register as required is itself a felony under Kansas law. Registration can also restrict where a person may live, work, and pursue education, and may require notification to neighbors.
